The Shore Club development planned for the northeast end of Long Bay Beach has been granted approval after a confidential agreement was reached with developer Stan Hartling concerning property transactions under investigation, the government announced July 1.

The government said only that the terms of the agreement “include a significant financial contribution to (government) and warranties regarding past actions and conduct. This civil settlement reflects the fact that there is no legal reason why (government) and the Shore Club should not advance the development.”

The government has accused former planning director Clyde Robinson and Richardson Anthony Arthur in separate cases of getting Crown land to build personal residences and flipping the properties to the developer for huge profits, which is forbidden by Crown land policy.

In Robinson’s case, he is accused of getting a piece of Crown land in March 2007 for $70,000 and with the aid of his wife selling it for $1.5 million while he was planning director. Before the allegations were made, he was reassigned as under secretary in the Ministry of Environment and District Administration and was subsequently suspended from office in December.

Arthur is accused of getting title to Crown land in January 2008 for $50,000 and flipping it two months later for $1.35 million.

The government is seeking to recover the illegal profits in both cases. Approval for the Shore Club has been on hold while the government’s Civil Recovery Team investigated both transactions.

“The developers co-operated fully with (government) in its review,” government said. “As a result of that exercise, certain civil claims which (government) felt it had, but which the developer disputed, have now been resolved by a settlement agreement.”

“The claims brought by (government) against Richardson Arthur and Clyde Robinson, and any future claims against other individuals arising out of the sale of land to the development company, will not affect the Shore Club development which can now proceed,” the government said.

“It is (government’s) policy not to approve any development unless it is satisfied that no improper conduct is associated with the development and its shareholders/directors and all outstanding civil issues are resolved to (government’s) satisfaction; or that its rights are fully protected in the event of such misconduct coming to light in the future: all new development agreements contain robust anti-bribery provisions,” government said.
