DECR enforcing laws on fishing, sand mining PDF  | Print |  E-mail

Enforcement officers of the Department of Environment and Coastal Resources have been busy making cases against people who violate fishing and sand mining laws.

“The DECR is serious and committed about protecting the environment and the natural resources of the Turks and Caicos Islands,” DECR Director Wesley Clerveaux told the fp. “We recognize that the environment is the driving factor of our tourism based economy, and the responsibility to ensure the sustainable use of these resources falls on the shoulders of the DECR, a responsibility which we take very seriously.

“We will expand all efforts and to the best of our resources to apprehend and prosecute anyone found in violation of the environmental and fisheries laws of the TCI.”

Most fishing violations involved Belongers and Haitians taking undersized lobster off South Caicos and Providenciales. Those resulted in fines or probation, but breaking laws in national parks and illegal sand mining drew tougher punishments.

Two men were sent to jail for fishing within the North West Point National Park off Providenciales. Jean Macenuer was sentenced to nine months, and Isaac Charles was sentenced to seven months.

Two other men caught filling a pickup truck with sand near North West Point Resort last year were sentenced in March to pay big fines by May 13 or go to prison. St. Martin Valmera must pay $20,000 or serve 60 days, and Duverna Louis Rigby must pay $4,000 or serve three months for illegal sand mining.

Johnston International Ltd. and Jade Louise were charged with illegal sand mining of 21 yards of sand in 2009, but that case has been removed from the courts because the company was put into receivership in July 2010.

Other recent convictions include:

  • Russel Jennings was fined $1,000 and put on probation for a year after being caught on South Caicos with 177 pounds of undersized lobster tail (equivalent to 531 pounds of whole lobster).
  • On Grand Turk, two people were given the choice of paying a $500 fine or serving 10 days in prison for illegally processing dried conch without a license in April. Raymond Ettiene was caught with 200 dried conch, while Bernadette Nerius was caught with 95 dried conch.
  • Joseph Ernest and Dwight Ewing were convicted of illegally fishing with spear gun and taking marine products in the Columbus Landfall National Park off Grand Turk. They were each ordered to pay a $500 fine and were put on probation for a year.
  • Floyd Bethel of Providenciales was put on probation for possession of 27 pounds of undersized lobsters he brought to the Provo Conch and Seafood processing plant.
  • Velmon Forbes and Timothy Pierre were put on probation for one year for fishing without a license in an unlicensed vessel off South Caicos.
  • Ronelle Michell and Broze Pierre were put on a probation for a year for possessing and using a spear gun off South Caicos.
  • Harold Walkin, John Walkin and Wilson Simon were put on probation for a year for possessing two egg-bearing lobsters on South Caicos.
